Terms of Service

In these Terms of Service, the following definitions apply:

• "Platform" means the Hord Nest website, dashboard, APIs, and all associated services operated by Hord Nest Ltd.
• "User", "You", "Your" means any individual or entity that accesses or uses the Platform.
• "We", "Us", "Our", "Hord Nest" means Hord Nest Ltd, a company registered in England and Wales.
• "Digital Assets" means cryptocurrencies, tokens, and other blockchain-based assets supported on the Platform.
• "Investment Plan" means a structured product offered through the Platform with defined terms, durations, and projected returns.
• "Trading Pool" means a collective investment vehicle where multiple users pool capital for algorithmic trading strategies.
• "KYC" means Know Your Customer procedures required under applicable anti-money laundering legislation.

To use the Hord Nest Platform you must:

• Be at least 18 years of age or the age of majority in your jurisdiction, whichever is greater.
• Have full legal capacity to enter into binding agreements.
• Not be a resident of or located in any jurisdiction where use of the Platform would be prohibited or restricted by local law, including but not limited to the United States of America, Iran, North Korea, Syria, and Cuba.
• Successfully complete our KYC and AML verification process where required.
• Not be a politically exposed person (PEP) or have been subject to any financial sanctions.

We reserve the right to refuse service, suspend, or terminate accounts of any user who does not meet these eligibility requirements.

When creating an account on Hord Nest, you agree to:

• Provide accurate, current, and complete information during the registration process.
• Maintain and promptly update your account information to keep it accurate.
• Maintain the security and confidentiality of your login credentials and two-factor authentication devices.
• Notify us immediately of any unauthorised use of your account at security@hordnest.com.
• Accept responsibility for all activities that occur under your account.

Hord Nest will never ask for your password by email, telephone, or any other medium. You must not share your credentials with any third party.

Hord Nest offers two primary investment products:

4.1 Structured Investment Plans

Investment Plans are fixed-term products where you commit capital for a defined period in exchange for a projected daily or weekly return. All projected returns are indicative only and are not guaranteed. Actual returns may vary based on market conditions and strategy performance.

4.2 Trading Pools

Trading Pools allow users to contribute capital to a collective fund managed by algorithmic trading strategies. Pool allocations are pro-rated. Entry and exit are subject to pool-specific terms, including minimum commitment periods and withdrawal notice requirements.

By participating in any Investment Plan or Trading Pool, you acknowledge that:

• The value of your investment may decrease as well as increase.
• Past performance is not indicative of future results.
• You may receive back less than you invested.
• Returns are denominated in the same digital asset as your deposit (USDT, BTC, or ETH).

The following fees may apply when using the Hord Nest Platform:

• Performance Fee: Hord Nest charges a performance fee of up to 15% on net profits generated through Investment Plans and Trading Pools. This fee is deducted automatically before returns are credited to your account.
• Withdrawal Fee: A network fee is charged on all withdrawals to cover blockchain transaction costs. This fee varies by asset and network congestion.
• Early Exit Fee: Withdrawing capital from an Investment Plan before its maturity date may incur an early exit penalty of up to 5% of the withdrawn amount.
• Inactivity Fee: Accounts with no login activity for 12 consecutive months may be charged a monthly inactivity fee of $5 equivalent.

All fees are subject to change with 30 days' notice. Continued use of the Platform after fee changes constitutes acceptance of the new fee schedule.

All deposits must be made in supported digital assets (USDT, BTC, ETH) to the wallet address provided in your dashboard. Deposits of unsupported assets sent to Platform addresses may be permanently lost.

Withdrawals are subject to:

• Completion of KYC verification at the applicable tier.
• A processing period of 1–5 business days for amounts above $10,000 equivalent.
• Compliance checks under our AML policy, which may delay or restrict withdrawals.
• Plan-specific lock-up periods for active Investment Plans.

Users must not use the Platform to:

• Engage in money laundering, terrorist financing, or any other criminal activity.
• Manipulate markets or engage in wash trading, spoofing, or other deceptive practices.
• Create multiple accounts to circumvent limits or KYC requirements.
• Access the Platform using automated bots, scrapers, or other unauthorised means.
• Attempt to reverse-engineer, decompile, or exploit Platform infrastructure.
• Impersonate Hord Nest staff or other users.
• Transmit malware, ransomware, or other malicious code.

Violation of any prohibited activity may result in immediate account suspension, asset freezing, and referral to the appropriate law enforcement authorities.

All content on the Platform — including logos, brand identity, text, graphics, software, algorithms, and data — is the exclusive property of Hord Nest Ltd or its licensors and is protected by applicable intellectual property law.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform for personal investment purposes only. This licence does not include any right to:

• Reproduce, distribute, or publicly display Platform content.
• Create derivative works based on Platform content.
• Use Platform data for commercial purposes without written permission.

To the maximum extent permitted by applicable law, Hord Nest Ltd, its directors, employees, agents, and licensors shall not be liable for:

• Any loss of capital or investment returns.
• Any indirect, incidental, special, consequential, or punitive damages.
• Loss of data, goodwill, or business opportunity.
• Losses arising from blockchain network disruptions, exchange failures, or smart contract vulnerabilities.
• Losses arising from force majeure events including regulatory actions, market crises, or natural disasters.

Our aggregate liability in connection with the Platform shall not exceed the fees paid by you in the 12 months preceding the claim.

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Before commencing legal proceedings, you agree to first attempt to resolve any dispute through our internal complaints procedure by contacting contact@hordnest.com. We will endeavour to respond within 10 business days.

Hord Nest reserves the right to modify these Terms at any time. We will provide at least 14 days' notice of material changes via email and a prominent notice on the Platform. Your continued use of the Platform after the effective date of any changes constitutes acceptance of the updated Terms.
